On the other hand, the individual or legal entity purchasing products or services from the Company, hereinafter referred to as the "Buyer" or the "Customer".
It has been mutually agreed as follows:
By using kaosix.com and/or placing an order, you agree to comply with all clauses and conditions presented in this document (the "Terms and Conditions"). Please ensure that you have carefully read and understood these Terms before placing your order.
The presentation of products or services on kaosix.com at any given moment does not imply or guarantee that these products or services will be available at all times. We reserve the right to discontinue the sale of any product at any time.
We also reserve the right to occasionally modify these Terms without prior notice. The version of the Terms applicable to your order will be the one posted on kaosix.com at the time you place your order.
The shipment of an order of a product presented in the Kaosix electronic catalog implies acceptance without reservation of these Terms and Conditions, which prevail over any clauses added by the Customer and govern the contractual relationship between the parties.
Article 1: Purpose
The Terms and Conditions of Sale (T&Cs) apply exclusively to the sale by the Seller of Products presented on the Site, which is freely and freely accessible to all internet users. The T&Cs apply exclusively to products delivered to consumers worldwide. The T&Cs and all contractual information are written in French and available to consumers on the Seller's Site, directly accessible and also available upon simple request via email or postal mail.
Article 2: General Provisions
These Terms and Conditions govern the sale of products or services conducted through the Company's website and are an integral part of the contract between the Buyer and the Seller. They are fully binding on the Buyer who accepted them before placing the order.

The Company ensures the acceptance is clear and unconditional. The Customer acknowledges reading these Terms and any specific conditions related to a product or service and accepts them without restriction.
The Customer confirms that they have received the necessary advice to ensure the offer meets their needs.
The Customer declares having the legal capacity to contract according to the laws of their country or validly representing the person or entity for which they commit.
In the absence of proof to the contrary, the information recorded by the Company shall constitute proof of all transactions.
Article 3: Prices
Prices of products sold on the website are indicated in Euros including all taxes (VAT included). They are also indicated inclusive of tax on the product order pages, excluding specific shipping fees. Applicable shipping fees are shown before order confirmation and charged in addition to product prices. The Company reserves the right to modify prices at any time for future orders.
The Buyer may be subject to local obligations, taxes, or import duties payable upon arrival of goods at the destination. The Seller has no control over these fees, which remain the sole responsibility of the Buyer. Customs policies vary by country, so Buyers should check local customs regulations. When ordering, the Buyer is considered the official importer and must comply with all laws and regulations of the receiving country.
Article 4: Order
The Customer must follow a series of steps to complete the electronic contract: product information, product selection and options if any, provision of Customer’s contact details, acceptance of these Terms, verification and confirmation of order details and price.
Before confirming, the Buyer can review and correct any errors or cancel the order. Confirmation of the order forms the contract. Payment instructions follow, then payment and product delivery. The Customer receives an email confirmation of payment and order receipt.
Order details, communications, and invoices are archived securely and can be used as proof of contract.
Delivery will be made to the Customer's indicated delivery address. The Customer commits to providing accurate details. The Seller may refuse any abnormal or bad faith orders.
If unable to fulfill an order, the Seller will notify the Buyer promptly and offer alternatives (equivalent product or store credit). In case of disagreement, the Seller refunds using the original payment method.
Article 5: Products and Services
Essential product features and prices are provided on the Company’s website in French. Photos are for illustration only and not contractual. Rights granted apply only to the person placing the order or holder of the stated email.
The Seller commits to honoring orders within stock availability.
Article 6: Compliance and Warranty
Products benefit from legal conformity and hidden defects warranties. Non-compliant products may be returned, exchanged, or refunded. Claims must be made by email within two business days of delivery, including detailed problem description and order number. Photos may be requested. Return shipping costs for defective or non-compliant products are borne by the Seller.
Consumer protection rights apply as per law, including a 2-year period starting at delivery.
Article 7: Retention of Title Clause
Products remain property of the Seller until full payment is received.
Article 8: Delivery
Products are deliverable worldwide. Delivery means transfer of physical possession or control. Average delivery time is 10 to 20 business days, excluding processing time. Delays do not justify order cancellation or compensation.
Risk of loss passes to Customer on delivery by carrier.
Incorrect delivery addresses requiring re-shipment will incur additional shipping fees paid by the Customer.
Article 9: Availability
Products offered remain available while visible on kaosix.com and subject to supplier stock. Customers will be notified of delays over 5 business days and may cancel and be refunded.
Article 10: Payment
Payment is due immediately at order, including for preorders. Payment methods include internationally recognized credit cards and PayPal. Payments are secured and processed immediately. Payment commitments are irrevocable. In case of payment error, the order is void and canceled.
Article 11: Withdrawal Period
Customer may withdraw within 14 days from receipt, contacting the Company via https://www.kaosix.com/en/pages/livraison-remboursement-retour. Product and shipping price refunded, return shipping by Customer. Returns must be in original condition with proof of purchase. No withdrawal right under Swiss law.
Article 12: Disputes
Seller not liable for damages from product misuse. Liability limited to order value. Disputes handled amicably before legal action.
Article 13: Claims and Mediation
If customer service fails to resolve disputes within two months, mediation via the European Commission platform is possible at https://consumer-redress.ec.europa.eu/index_en. Failing amicable resolution, parties may bring disputes to competent courts.
Article 14: Contract Termination
Order may be terminated by Buyer by registered letter in cases of non-conforming product delivery, delay exceeding set limits, or unjustified price increase. Contract forms upon Buyer’s order confirmation and is archived as contract proof. Seller may terminate for refusal of delivery or non-payment.
Article 15: Intellectual Property Rights
Trademarks, domains, software, images, videos, texts and all intellectual property remain Seller’s exclusive property. No transfer of rights occurs through these T&Cs. Reproduction or use for any reason is prohibited.
Article 16: Force Majeure
Seller’s obligations are suspended in case of force majeure events. Seller notifies Customer as soon as possible.
Article 17: Nullity and Modification
Invalidity of any contract clause does not affect others. Contract modifications valid only by written agreement.
Article 18: Personal Data Protection
Regarding the protection of individuals with respect to the processing of personal data and the free movement of such data, the Seller implements a personal data processing system aimed at the sale and delivery of products and services defined in this contract. The Buyer is informed of the following:

Identity and contact details of the data controller and, where applicable, the representative of the data controller: the Seller, as indicated at the top of these Terms and Conditions;

Legal basis for processing: Contractual performance;

Recipients or categories of recipients of personal data, if any: the data controller, its marketing departments, IT security departments, the department in charge of sales, delivery and orders, subcontractors involved in delivery and sales operations, as well as any authority legally authorized to access the personal data in question;

Data retention period: the duration of commercial prescription;

The data subject has the right to request from the controller access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing as well as the right to data portability;

The data subject has the right to lodge a complaint with a supervisory authority;

The information requested during the ordering process is necessary for the establishment of the invoice (legal obligation) and the delivery of the goods ordered, without which the order cannot be placed. No automated decision-making or profiling is implemented through the ordering process.
